1. Introduction

Welcome to Elmsley Studio ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1.1 Acceptance of Terms

By placing an order through our website or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our Services.

2. Products and Orders

2.1 Product Descriptions

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be accurate. All wood products may have natural variations in grain, color, and texture that make each piece unique.

2.2 Custom Furniture

For custom furniture orders:

• All custom orders require a 50% non-refundable deposit upon order confirmation
• Production begins only after final design approval
• Lead times vary based on complexity (typically 6-12 weeks)
• Changes after production begins may incur additional charges

2.3 Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.

3. Pricing and Payments

3.1 Pricing

All prices are in Indian Rupees (₹) and are subject to change without notice. We reserve the right to modify or discontinue any product at any time without notice.

3.2 Taxes

Prices do not include GST or other applicable taxes, which will be added to your total at checkout based on your shipping location.

3.3 Payment Methods

We accept all major credit/debit cards, UPI, net banking, and select digital wallets. Payment is due in full at the time of order unless otherwise arranged for custom orders.

4. Shipping and Delivery

4.1 Shipping Policy

We ship throughout India via trusted carriers. Delivery times are estimates and not guaranteed. Risk of loss passes to you upon delivery to the carrier.

4.2 Delivery Inspections

You must inspect all items immediately upon delivery. Any damage or discrepancies must be reported within 48 hours of delivery to be eligible for replacement or refund.

4.3 White Glove Delivery

Our premium delivery service includes in-home placement and basic assembly. Additional assembly services may be available for an extra fee.

5. Returns and Refunds

5.1 Standard Returns

Due to the custom nature of our products, standard furniture items may be returned within 14 days of delivery for a refund (minus shipping costs) if in original condition. Custom pieces are non-returnable.

5.2 Damaged Items

We will replace any item damaged during shipping at no cost to you, provided you notify us within 48 hours of delivery with photographic evidence.

5.3 Refund Processing

Refunds will be issued to the original payment method within 14 business days of receiving the returned item. Custom order deposits are non-refundable.

6. Warranties

6.1 Structural Warranty

All furniture carries a 10-year warranty against structural defects in materials and workmanship when used under normal conditions.

6.2 Finish Warranty

Our hand-applied finishes are guaranteed against peeling or cracking for 2 years under normal use.

6.3 Warranty Limitations

Warranties do not cover damage from:

• Improper assembly or use
• Accidents, abuse, or neglect
• Exposure to extreme temperatures or humidity
• Normal wear and tear

7. Intellectual Property

All content on our website, including designs, logos, text, and images, are our exclusive property or used with permission. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Elmsley Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our products or services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of our Services after such modifications constitutes your acceptance of the new Terms.
